CFK Policies

We have designed these policies in order to give you the best possible membership experience, and to allow us to efficiently and effectively administer all of your memberships with our awesome but tiny staff!  We think these policies are fair, and we will try to always be fair and treat you right. If you think something isn’t fair, please see one of the coaches. By signing our waiver and paying any membership fees you agree to all the below policies:

House Rules:

Get your money’s worth. You paid for the entire hour – plan to stay for it. Regardless of how long the workout lasts, each of our classes is programmed to be an hour long. Time not spent doing the WOD is spent warming up, improving mobility, providing instruction for the WOD, and loosening/cooling down after the WOD. TO ensure safety and getting the most out of each workout, please plan to be in class for the full hour.

Think of Others. Not only should you get your moneys worth, but so should the person to your left and your right. As soon as class starts, so does the education, instruction and fun. Don’t be distracting to others by talking about your latest chemical face peel while the coach is explaining the WOD. This goes for those finished with class while the next class has started. Socializing, getting to know your CFK community and comparing WOD times is encouraged but do so with consideration of others.

Be Aware of Surroundings. Our box is cozy. Please be careful when handling equipment with others around. If quarters are close, do not drop bars. Do not leave unnecessary equipment on the ground that may cause injuries.

Keep it Clean. Help foster our sense of community by cleaning and sterilizing the equipment you use prior to returning it to it’s proper place. Spray bottles and green equipment wipe-down rags are conveneitnly located throughout the gym; please use them to wipe down any bars, mats, equipment, or floor-space, or anything else you’ve sweat on during your workout. Remember – the class immediately following yours has the right to a workspace as clean as the one provided to you during yours.

The Word is the WOD. Unless specifically instructed by the coach, all class attendees must follow the WOD as directed by CrossFit Kapa’a. While attendees may consult with the Coach in order to scale each WOD according to their ability level, we do not allow attendees to do an alternative WOD unless it has been both discussed with and approved by the coach prior to the start of class.

Chalk is a Privilege – Not a Right. Chalk is the curse of the gym owner. It helps improve grip, but it also can be exceptionally messy, and can lull clients into a false sense of security regarding grip-strength. Don’t be surprised if the chalk decides to hide on occasion…especially if folks aren’t responsible with it. Remember – chalk belongs on hands, in a bucket, or on a bar…and nowhere else.

Be On-Time.  Classes start exactly when advertised. Attendees who arrive late to class may be subject to extra work as assigned by the coach. Habitual offenders may subject the entire class to extra work as assigned by the coach (seriously). Be advised that if you are more than five minutes late to a class, the Coach reserves the right to assign you a different workout, or to deny participation in the class. We try to be fair with this policy, and will do our best to accommodate each and every athlete as the circumstances allow; Please understand that this is for both your safety and the safety and experience of those around you. Some workouts require the full 60 minutes, and can’t accommodate interruptions and repeated instructions.

Healthy Competition is Encouraged. Emphasis on Healthy. One of the nice things about working out in a group is how the dynamic lets individuals push one another. We welcome and encourage such competition – it’s part of what makes CrossFit unique. Any hard feelings arising from such competitions, however, aren’t welcome. Workouts are binary functions – you have it on that day, at that time…or you don’t. Life is too short to be spent being bitter over such things – we don’t tolerate those who are.

Check Your Ego at the Door. CrossFit is humbling for everyone…just a different times. For every workout which makes you feel like a rockstar, there’s another one which will leave you feeling absolutely crushed. When you fortunate enough to have one of the former, recognize that the latter could be right around the corner. It makes the experience more enjoyable for everyone.

Terms and Conditions

By signing this agreement, I (the “client” and “undersigned”) understand that I will be entering into a legally enforceable agreement with CrossFit Kapa’a(all associated CrossFit Kapa’a Facilities, classes and events) as follows: Please enroll me in the program I have selected and, subject to CrossFit Kapa’a’s Guarantee; I agree to pay your fees as indicated. I understand that the terms and conditions of this Agreement will govern all aspects of my participation in each Class I take and the fee arrangements I elect to make. I also agree to comply with the policies and procedures that you and your instructors may from time-to-time communicate to me

These policies supercede all previous policies and apply to all clients.  We reserve the right to update these policies at any time.  The term “membership” includes all CrossFit, Kids, Foundations Course, Private Training, Powerlifting, and Olympic Weightlifting memberships, as well as any other group class membership we offer.  The term “private training session” includes all individual private training, semi-private training, in addition to any other private or semi-private session we offer.

Herein, CrossFit Kapa’a and staff may be referred to, but not limited to, any of the following terms: (we), (we’re), (us), (coach{es}). Members, clients, drop-ins, or any person stepping into the gym may be referred to, but not limited to, any of the following terms: (you), (your).

  • All memberships and private training sessions are non-refundable, non-exchangeable, and non-transferrable.
  • All non-contract memberships and private training sessions must be paid in advance and in full. The first full month of contract memberships must be paid in advance and in full.
  • We reserve the right to cancel or reschedule classes and private training sessions within 24 hours to accommodate holidays, or special events. No refunds or credit will be granted due to schedule changes.
  • In the case of emergency, we have the right to cancel or reschedule classes with no previous notice.
  • We don’t think this will happen much, but just in case, we reserve the right to:
  • Refuse you entry to class if you turn up more than 15 minutes late.
  • Cancel your private training session if you turn up more than 15 minutes late (making the session subject to our cancellation policies as detailed below.)
  • Kick you out of class if you are a pain in the ass*.
  • Terminate your membership or private training sessions at any time if you are a serial pain in the ass*. Should it come to this, we will refund you the pro-rated balance on your membership or private training sessions.
  • All memberships are subject to the following rules and limitations:
  • You must review, understand, and adhere to the House Rules.
  • Participation in group class is at the sole discretion of the CFK coaching staff.  If the staff has concerns about your ability to safely participate in group class, you may be required to train privately.
  • Listen and follow all instruction by the coach to a reasonable degree.

* Determination of what constitutes a pain in the ass is at the discretion of the Owners. We are reasonable people, and we would only make this determination if you have driven us to the EDGE.

Billing, Auto-Renewal & Expiration Dates

  • Memberships begin on the date you sign up.
  • Monthly membership renew on the same day of the month as your sign-up date (i.e. if you sign up on the 11th, you’ll be billed each month on the 11th.)
  • For memberships where this is relevant, the week is Monday-Sunday.
  • Contract memberships are a commitment to 1 year of membership. You will be billed monthly for 12 months.
  • All contracts will renew after end date for the next year of contracted membership unless you cancel at least 7 days before the next bill date.
  • In case of termination of membership before contract has ended, you must pay the difference between the contracted price vs. the monthly price for the remanding amount of months on the contract plus an additional $50 cancellation fee. E.g.: 3 months remaining on contract at $115/month ($130 for monthly) = $95 must be paid.
  • All punchcards expire after 6 months.
  • Failure to attend class does not relieve you of the obligation to pay for your membership.

Past Due Payments / What Happens If Your Card Doesn’t Go Through

  • We understand that cards are often lost or stolen or expire, and a charge will sometimes be declined. We ask that in this case, you provide us with updated billing information in a timely manner, which we define as within two weeks. Should your requested payment method fail, and should you fail to specify a replacement method within two weeks, we reserve the right to charge any other payment method for you that we have on file or terminate your membership.
  • Payments more than two weeks past due will be subject to a $20 administrative fee.
  • Should payment be made more than two weeks late 3 or more times, we refuse the right to terminate membership or if you have a contract membership, you will have to pay the balance of the contract up front in order to continue.

Freeze Policy

All contracted memberships may be temporarily frozen. This is a courtesy to accommodate the occasional vacation, illness, or injury.  If you’re not sure what your schedule will be, please purchase a punch card instead of a contracted monthly membership.  To place a membership on hold, please contact Charlotte with your requested hold dates and a confirmation that you understand the following hold conditions:

  • The minimum hold period is two weeks.
  • The maximum hold period is 3 months.
  • An administrative hold fee of $20 will be assessed at the start of each hold period.
  • Holds longer than one month will incur a $20 charge for each month the membership remains on hold.
  • Once 3 months of hold has been reached, the membership must either be reactivated, or it will be dropped and charged any remaining monthly dues and cancellation fees.
  • There are no retroactive holds: you must let us know in advance if you wish to place your membership on hold.
  • Upon expiration of the hold, the member’s account will automatically become active, and payments will resume.

Cancellation Policy

  • Non-contract memberships: Non-contract memberships will be cancelled upon expiration of their term (e.g. after the month is up) with no penalty. To renew your non-contracted membership, contact Charlotte renew.
  • Contract memberships: We will allow you to cancel your contract for any reason for the fee of the discount you received for signing it plus $50 cancellation fee (e.g. if you use 9 months of a 1 year contract, you’ll be able to break it for $95 — the 3x$15 you saved by signing the contract plus fees). To cancel a membership, contact Charlotte with your requested termination date and a confirmation that you understand that you will be charged the cancellation fee.

Membership Rates and Lapses 

Our general policy is to honor membership rates as long as the membership is maintained.  This means that should our rates increase, you will not be subject to said increase unless you allow your membership to lapse.

  • Membership lapses include but are not limited to:
  • Memberships dropped at the specific request of the member.
  • Memberships dropped due to expiration of the maximum hold period.
  • Memberships dropped due to non-payment.  We will give you a grace period of two weeks to correct any billing issue (expired or invalid credit card) before memberships are dropped for this reason.

Foundations Course and Test-Out Options

  • Foundations Course or Test-Out (one time testing of yourself to determine if you are ready to enter general classes) is REQUIRED for entry to regular classes (with the exception of Saturday Community Class). This is for the safety of you and all other members. No exceptions. If you come to a general class without taking the Foundations Course or Test-Out, you may watch from the side but not participate.
  • Foundations Courses are limited to 8 people per course. Your spot in the course is not secured until payment has been received in full.
  • There are no refunds, exchanges or transfers for the Foundations Course or Test-Out.
  • All Foundations Course students are entitled to one make up class if they miss a schedule class. Talk to the coach about scheduling one.
  • All CrossFitters coming from other CrossFit boxes, must test-out/consult with a coach.
  • All sessions expire one year after purchase.
  • Graduation from Foundations Course is at the sole discretion of the CFK coaching staff.  If the staff has concerns about your ability to safely participate in group class, you may be required to continue training privately.

Private Training

  • Sessions requested through the website must be confirmed by a coach.  Please do not consider your appointment final until a coach has confirmed with you. This is particularly true if you are booking at the last minute — a coach will probably not be here at 7am if you booked your appointment at midnight!
  • We have a strict 24-hour cancellation policy. If a confirmed appointment is cancelled with less than 24 hours notice, you will be charged for the session.  To reschedule an appointment with more than 24-hours notice, please contact your coach directly.
  • All sessions expire one year after purchase.

Children Policy

All children present at CrossFit Kapa’a facility, events, or classes must abide by the same House Rules (shown above). They are to stay in a safe area away from clients, members, attendees, and all equipment, unless otherwise given permission. Children are the responsibility of their parents/guardians. CrossFit Kapa’a assumes no responsibility over children. Damages made by children to facility or attendees are the responsibility of their parent/guardian.

Childcare 

Childcare services are for the child(ren) of members of CrossFit Kapa’a only. All child(ren) brought to childcare at CFK must be healthy, carrying no contagious illness or virus, they are expected to behave in a appropriate manner according to the childcare provider. The childcare provider and CrossFit Kapa’a are not responsible for any injuries, sickness, or damages of the child(ren). By bringing your child(ren) to childcare, you are assuming all risks involved with your child(ren) and take full responsibility for any damages acquired.

Service Limitations

I understand that you have the right to suspend and/or terminate this Agreement and/or my participation in any Program for any cause or reason, to include my non-payment of fees, or for any behavior deemed by CrossFit Kapa’a’s management to be harmful or inappropriate to the enjoyment, and/or participation of any other client or CrossFit Kapa’a’s instructor/trainer. Termination may be without any refund of any fees I may have paid.

Damages

Clients shall pay for any damages to the CrossFit Kapa’a’s property which results from the willful or negligent conduct of client, Client’s guest or dependent children.

Lost Articles

CrossFit Kapa’a assumes no responsibility for lost or stolen articles. Lost and found articles not claimed will be donated to charity.

Change of Rules and/or Regulations

CrossFit Kapa’a reserves the right to add to, change or remove rules, conditions of membership, opening and closing hours and the services and facilities offered by CrossFit Kapa’a from time to time.
